Free Real Estate Broker (National) Flashcards

Courts and brokers start with the fixture tests: how firmly the item is attached, whether it was adapted to the property, the parties' intent, and any agreement. The built-in dishwasher is plumbed and wired into cabinetry, so it is a fixture that conveys as real property. The window unit simply rests in the opening and is removable, so it remains the seller's personal property. A listing of included items in the contract would settle the dispute either way.
