Free California Real Estate Salesperson Flashcards

Real property is land plus whatever is affixed or incidental to it (Civil Code 658), and a thing is affixed when attached by nails, bolts, screws or cement, or when it permanently rests on the land (Civil Code 660). The hardwired fans pass with the house as fixtures. The freestanding refrigerator is personal property that leaves with the seller unless the contract includes it. The shed is the close call, so the agent should have listed it either way.
